FOX31 legal analyst Christopher Decker spoke with reporter Vicente Arenas about a hit-and-run crash near Coors Field in downtown Denver, where a pedestrian was struck and seriously injured by a driver who left the scene.
Decker explained that Colorado law places an affirmative duty on any driver involved in a crash to stop, remain at the scene, and report the accident. The consequences of leaving escalate sharply with the severity of the injuries involved.
“In a case like this where the driver has struck an individual and has left the scene, they are facing up to 12 years in prison if the injuries sustained were defined under Colorado Law as serious bodily injury.”
Denver police have asked for the public’s help identifying the vehicle involved.
Leaving the scene is charged separately from the underlying crash, and the difference between a misdemeanor and a felony often turns on medical findings rather than on what the driver knew at the time.
